This Privacy Policy explains how The Cricket Draft Ltd ("we", "us", "our") collects, uses, and shares your personal data when you use our website (www.thecricketdraft.com) and our mobile application ("The Cricket Draft") (collectively referred to as the "Services"). For the purposes of the UK General Data Protection Regulation (UK GDPR), The Cricket Draft Ltd is the "data controller" of your personal data.

This policy applies to both of our primary offerings:

  • The Cricket Draft Fantasy (“Fantasy”): Our free-to-play fantasy cricket game (available via the website and app).

  • ​The Cricket Draft Duels ("Duels"): Our regulated real-money pool betting product (available via the app).


1. IMPORTANT DISTINCTION: FANTASY VS. DUELS

Because Duels is a regulated gambling product licensed by the Great Britain Gambling Commission, the way we collect and process data for Duels users is fundamentally different from our Fantasy users.

  • Duels users: Must be 18 or older and resident in the UK. We are legally required to conduct strict identity, age, affordability, and anti-money laundering checks.

  • Fantasy users: Data collection is strictly limited to what is necessary to run the Fantasy game and provide marketing (where consented).


2. THE DATA WE COLLECT ABOUT YOU

We may collect, use, store, and transfer different kinds of personal data about you, depending on which Services you use:

  • Identity Data: First name, last name, date of birth, and gender. For Duels users, we may also be required to collect photographic ID documentation to verify your identity.

  • Contact Data: Email address, mobile phone number, location (country). For Duels users, we also strictly require a full UK residential address.

  • Profile Data: Your username, password, favourite team supported for each competition, survey responses and any feedback provided by you.

  • Communications & Social Media Data: Information you provide when you interact with us on social media platforms (e.g., X, Instagram) or correspond directly with our customer support teams.

  • Financial & Transaction Data (Duels Only): Duel entry, deposit and withdrawal history and associated account details. Please note: We use a secure third-party payment provider to handle all financial transactions. We do not directly collect, process, or store your sensitive raw payment card data on our systems.

  • Regulatory & Affordability Data (Duels Only): Where required by the regulator, data from credit reference agencies, open banking data, and income information used to verify you can afford to play safely. We also check your status against the GAMSTOP national self-exclusion database.

  • Technical & Usage Data: IP address, device identifiers, browser type, how you interact with our website and app, game performance, and time spent playing.

  • Marketing & Advertising Data: Your preferences for receiving marketing from us, our commercial partners, the specific cricket teams you support, and your consent preferences for targeted programmatic advertising.


3. HOW WE COLLECT YOUR DATA

  • Third Parties or Publicly Available Sources: 

    • Identity & Age Verification: We receive data from our third-party verification providers to confirm your identity and age.

    • Financial & Affordability: We receive credit bureau data, public records, and open banking data from our third-party suppliers to meet our regulatory requirements.

    • Payment Providers: We receive transaction confirmations from our secure payment gateways.


4. HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when the law allows us to. Most commonly, we use it for the following purposes:

  • To provide the Services (Performance of a Contract): To register your account, manage your participation in Fantasy or Duels, calculate scores, process Duels deposits/withdrawals, and contact the winners of our games to arrange prize collection.

  • To comply with Regulatory Obligations (Duels Only): To verify your age and identity, conduct affordability, responsible gaming and anti-money laundering checks, check your self-exclusion status, and prevent fraudulent practices.

  • For our Legitimate Interests: To run analytics to improve our website and app, to conduct surveys to improve user experience, and to keep our platform secure.

  • With your Consent: To send you direct marketing via email, to share your details with your chosen supported team or our commercial brand partners, and to serve you personalized programmatic advertising (using tools like Google Ads) within our Fantasy platform.


5. DISCLOSURES OF YOUR PERSONAL DATA

We may share your personal data with the following third parties:

  • Service Providers: External CRM tools, payment processing partners, IT/cloud hosting providers, and analytics/programmatic advertising platforms (such as Google).

  • Regulatory Partners (Duels Only): Identity verification agencies, credit reference bureaus, open banking platforms, and GAMSTOP to fulfil our legal gambling license obligations.

  • Regulators and Law Enforcement: The Great Britain Gambling Commission, IBAS, or other law enforcement agencies if we suspect fraudulent activity, money laundering, or sports integrity issues (such as match-fixing).

  • Cricket Teams: If you give us your explicit consent, we will share certain Identity and Contact Data with your chosen favourite cricket team to help them interact with fans.

6. INTERNATIONAL DATA TRANSFERS

Some of our external service providers are based outside the UK. Consequently, their processing of your personal data may involve a transfer of data outside the UK. Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring that appropriate safeguards are implemented, such as utilizing the UK Extension to the EU-US Data Privacy Framework or standard contractual clauses approved for use in the UK.


7. COOKIES AND TRACKING TECHNOLOGIES

We use cookies and similar tracking technologies to track activity on our website and app and hold certain information. These technologies are used for maintaining your session, remembering your preferences, analysing how our platforms are used, and delivering programmatic advertising. 8. CHILDREN AND PRIVACY

While The Cricket Draft Fantasy game is open to users of all ages, users aged 13 or under require verifiable permission from a parent or guardian to register for an account. We do not knowingly collect personal data from children under 13 for marketing or programmatic advertising purposes without this consent. Unverified child accounts are routinely deleted. (Note: The Duels platform is strictly 18+ and subject to age verification).
 

9. DATA SECURITY AND RETENTION

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way. We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for.

  • Fantasy Accounts: User accounts that have been dormant for a period of 3 years will be closed and any data securely deleted. Non-activated accounts are deleted after 30 days.

  • Duels Accounts: By law, we are required to retain certain transactional, affordability, and identity verification data for a specific period (usually up to 5 years) even after you close your account to comply with Gambling Commission and anti-money laundering regulations. After this time, it will be securely destroyed.

 

10. YOUR LEGAL RIGHTS

Under data protection laws, you have rights including to:

  • Request access to your personal data.

  • Request correction of your personal data.

  • Request erasure of your personal data (Note: This may not apply to certain Duels data we are legally required to retain).

  • Object to processing of your personal data.

  • Withdraw consent at any time (e.g., for marketing, advertising, or sharing with teams). You can update your preferences via your account settings.

If you believe we have not processed your data in accordance with the law, you also have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK regulator for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO, so please contact us in the first instance by email privacy@thecricketdraft.com.
